Terms of Use

Effective date: October 12, 2026

These Terms cover Calorate services, including AI features, user responsibilities, health disclaimers, and third-party tools.

1. Acceptance of These Terms

These Terms of Use govern your access to and use of Calorate websites, applications, tools, content, and related services. By accessing or using Calorate, you agree to be bound by these Terms. If you do not agree, you should not use the service.

2. Eligibility and User Responsibility

You are responsible for ensuring that your use of the service is lawful in your jurisdiction. If you use Calorate on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

You are responsible for the accuracy of information you submit and for maintaining the confidentiality of any account credentials under your control.

3. User-Submitted Information and Results

You retain ownership of information you submit to Calorate. You grant us only the limited rights needed to provide, secure, and support the service. When you use AI features, relevant messages, images, and context may be sent to the Google Gemini API to generate a response. Results may be inaccurate or unsuitable for your circumstances.

4. Nature of the Service

Calorate provides informational tools about nutrition, calories, food, and wellness. AI responses are generated automatically, may contain errors, and are not professional advice.

5. Health and Medical Disclaimer

You should consult a qualified physician, dietitian, or other licensed healthcare professional before making decisions based on nutrition, body composition, pregnancy, menstrual, breastfeeding, or other health-related outputs generated by the service.

If you believe you may be experiencing a medical emergency, contact emergency services or a qualified medical provider immediately.

6. Acceptable Use

  • You may not use the service in a manner that violates applicable law or regulation.
  • You may not interfere with, disrupt, or attempt to gain unauthorized access to the service, its infrastructure, or related systems.
  • You may not misuse automated methods, scraping tools, bots, or other mechanisms to access the service in an abusive or unauthorized manner.
  • You may not upload, submit, or transmit unlawful, harmful, fraudulent, defamatory, or infringing content through the service.

7. Accounts and Suspension

We may suspend, restrict, or terminate access to the service, with or without notice, if we reasonably believe that you have violated these Terms, created risk for users or the service, or where suspension is required for legal, security, or operational reasons.

8. Intellectual Property

Calorate and its content, features, branding, design elements, software, databases, and materials are owned by or licensed to Calorate and are protected by applicable intellectual property and unfair competition laws.

Except as expressly permitted by law or by us in writing, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, reverse engineer, or otherwise exploit the service or its content.

9. Third-Party Services and Links

AI features may use third-party services, including the Google Gemini API, to generate responses. Relevant requests and content are transmitted to that provider, and its terms and data practices also apply.

10. Availability and Changes

We may modify, suspend, or discontinue any part of the service at any time, with or without notice. We do not guarantee that the service or any feature will always be available, uninterrupted, secure, or error-free.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Calorate and its affiliates, officers, employees, contractors, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, revenue, or business opportunities arising out of or related to your use of the service.

Where liability cannot be excluded under applicable law, liability will be limited to the maximum extent permitted by that law.

13. Indemnification

You agree, to the extent permitted by applicable law, to defend, indemnify, and hold harmless Calorate and its affiliates, officers, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses arising from or related to your misuse of the service, your violation of these Terms, or your violation of applicable law or third-party rights.

14. Privacy

Your use of the service is also subject to our Privacy Policy, which explains how we process personal and health-related data and what information may be sent to AI providers.

15. Governing Law and Local Rights

These Terms shall be interpreted in a manner consistent with applicable law. Nothing in these Terms is intended to limit non-waivable consumer or privacy rights that may apply to you under the laws of your place of residence.

16. Changes to These Terms

We may update these Terms from time to time. If material changes are made, we will update the effective date on this page and, where appropriate, provide additional notice. Continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires a different process.
